ATOL Terms and Conditions

 

Diamond Resorts Travel is fulfilled by Contemporary Travel Solutions Ltd.

Contemporary Travel Solutions T/A Diamond Resorts Travel, company number 06664958, with its registered office address at 12 Grappenhall Road, Stockton Heath, Warrington, WA4 2AG (hereinafter “we”, “us” or “our”), operates the website with the URL www.diamondresortstravel.co.uk (“the Website”). We sell flight-inclusive Packages under ATOL number 11285.  This means that all the flights and flight-inclusive holidays are financially protected by the ATOL scheme. 

ATOL protection

In the event of a flights only booking, a flight inclusive Package or a Flights- Plus reservation made through us (for ease of reference “Arrangements”), we have the following responsibilities.

(For details of what constitutes a Package and Flight-Plus, please see our Booking Conditions).

(a) The failure or insolvency of a provider (as referenced below) will have the meaning prescribed in Regulation 23 of the ATOL Regulations 2012.

(b) If, before your intended departure we become aware that any part of your Arrangements will not be provided a) because of the insolvency of any person concerned with the provision of the Arrangements or b) because the ATOL holder providing your flight accommodation is insolvent or cannot or will not be able to meet its obligations to its customers, we will take reasonable endeavours to provide you with suitable alternative Arrangements at no extra cost. If it is impossible to make such Arrangements, we will give you a full refund of all monies paid to us in respect of your Arrangements.

(c) If, after your intended departure we become aware that your flight arrangements will not be provided a) because of the insolvency of any person concerned with the provision of the flight accommodation or b) because the ATOL holder providing your flight accommodation is insolvent or cannot or will not be able to meet its obligations to its customers, we or the Civil Aviation Authority (“CAA”) will provide you with suitable alternative transport back to the place of departure or to another return point to which you have agreed. 

(d) If, after your intended departure we become aware that your living accommodation or self-drive car hire will not be provided because of the insolvency of any person concerned with the provision of the living accommodation or self-drive car hire making up your flight inclusive package/ Flight-Plus, we will provide you with suitable alternative living accommodation or self-drive car hire (as applicable) at no extra cost. If it is impossible to make such arrangements, we will give you a full refund of all monies paid to us in respect of all unused flight accommodation, living accommodation, self-drive car hire and other tourist services forming part of your Arrangements.

(e) Where suitable alternative arrangements are provided as set out in clauses (b) – (d) above, we will where appropriate, pay you reasonable compensation, to include any incidental expenses reasonably incurred by you and evidenced by receipts. Compensation will not be payable if living accommodation or self-drive car hire is offered by us and accepted by you with a higher price than that originally booked and is supplied in the same location as originally booked where no additional payment is made by you.

(f) We will not make suitable alternative arrangements or pay you compensation in respect of any tourist services forming part of your Arrangements.  A refund will be given in respect of these services in the event of insolvency but we will have no further liability.

(g) In some circumstances, the CAA will arrange and fund the obligations set out in clauses (b) to (d) above. In this situation, we are entitled to levy a £25 claims processing fee per passenger which you agree to pay to us if such an event happens.  We reserve the right to invoice you for this separately or to deduct it from any refund sums due to you. In the event that the CAA takes on the obligation to provide you with alternative services, additional compensation will not be payable to you.

(h) We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money that is still to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL Scheme (or your credit card issuer where applicable).

Financial Security

We provide financial security for a flights only booking, a flight inclusive Package or a Flights- Plus reservation made through us by way of a bond held by the CAA under ATOL number 11285. When you buy a flight, a flight inclusive Package or a Flight-Plus from us you will receive an ATOL Certificate. This lists the flight, accommodation, car hire and/or other services that are financially protected, where you can get information as to what this means for you, and whom to contact if things go wrong.  For further information, visit the CAA website at www.caa.co.uk.  The price of our flight inclusive arrangements includes the amount of £2.50 per person as part of the ATOL Protection Contribution (APC) which we pay to the CAA. This charge is included in our advertised prices. Not all holiday or travel services offered and sold by us will be protected by the ATOL Scheme. ATOL protection extends primarily to customers who book and pay in the United Kingdom.

If we, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid the sums you have claimed under the ATOL scheme.

PLEASE NOTE: If you book other services from us other than a flights only booking, a flight inclusive Package or a Flights- Plus reservation, your monies will not be financially protected by us, but may be protected by arrangements that the other applicable supplier has in place.

PLEASE ALSO NOTE: Any accommodation reservations booked by you directly with Diamond Resorts International® (as opposed to through Contemporary Travel Solutions Ltd via Diamond Resorts Travel) are not covered by the ATOL scheme. This being the case, even if you purchase flights from us within 24 hours of booking your accommodation direct with Diamond Resorts International®, the reservation with us will constitute a flight only booking (for which you will have ATOL protection) but will not constitute Flight-Plus.
